Terms and conditions

General Terms & Conditions

WHEREAS

a) THE BEST RENT S.R.L., VAT No. 08434160969, represented by its legal representative Florentina Markaj, registered with the Milan Companies Register under no. MI - 2026339, with registered office in Milan, Viale Monte Nero 59, has been entrusted with a mandate with representation for the management aimed at granting temporary use of the property selected during the booking process by the Customer (hereinafter also referred to as the “Property”);
b) The Customer intends to stay at the Property for the period selected by them and in compliance with the terms and conditions set out in this document and in the lease agreement to be executed (hereinafter also referred to as the “Agreement”).
c) The Best Rent S.r.l., as a service company, shall handle the booking service and all related activities.
Now therefore, the Customer accepts the following terms of service:

1. Recitals and Attachments
The recitals and attachments form an integral part of these terms of service.

2. Subject Matter
These terms of service govern the procedures for booking and cancelling the stay at the Property, as well as the procedures for signing the Agreement.

3. Booking Procedure and Execution of the Agreement
3.1 The Customer shall select the property they wish to use for temporary accommodation among those listed on the website www.thebestrent.it or through other online platforms, and may submit a booking request for the selected property by contacting The Best Rent S.r.l. by phone at +39 0236683400, by email at booking@thebestrent.it, or through the website.
3.2 Following the information request received, The Best Rent S.r.l. shall send the Customer an email entitled “★★ First Name Last Name confirm your booking” regarding the selected Property, containing all information (via a link redirecting to an online page). In particular:
a) the address and characteristics of the selected Property;
b) the duration of the Agreement, specifying the period selected by the Customer;
c) the amount of the monthly rental fee and any tourist tax payable, if applicable;
d) the amount of the booking deposit (earnest money deposit) due for the reservation of the Property and the amount of the security deposit to be paid at check-in;
e) the applicable “Cancellation Policy” (as specified below in section 6);
f) the maximum number of persons allowed to occupy the Property;
g) the check-in and check-out times;
h) any additional extra-contractual services that may be provided to the Customer through third parties approved by The Best Rent upon request, together with the related costs.
3.3 On the same page, the Customer shall be required to accept these general terms of service by ticking the relevant checkbox, as well as an additional checkbox for double approval of certain specific and important clauses. At check-in, the Customer shall sign the lease agreement and the service agreement if the stay exceeds 30 days.
3.4 The booking deposit must be paid within 24 hours from the time the reservation is entered. After this deadline, the booking request shall become ineffective and The Best Rent S.r.l. shall no longer be required to guarantee availability of the selected Property.
3.5 The online page referred to in section 3.2 must be completed by the Customer with all required information (for example, the personal details and identification data of all persons occupying the Property). The Customer must also accept these general terms of service.
3.6 If the Customer chooses bank transfer as the payment method for the deposit to the account of The Best Rent S.r.l. or to an account of a delegate appointed by it, the Customer must send a copy of the bank transfer receipt to The Best Rent S.r.l. by email within the following 24 hours.
3.7 If the Customer sends proof of payment after the deadline indicated in section 3.6 and the selected Property is no longer available, The Best Rent S.r.l., where possible, shall propose another available property to the Customer, indicating any price difference payable.
3.8 Within 24 hours from receipt of the communication referred to in section 3.7, the Customer must notify The Best Rent S.r.l. by email of acceptance of the new property.
3.9 If the Customer does not accept the proposed change of property, the Customer must notify The Best Rent S.r.l. in writing, and The Best Rent S.r.l. shall refund the deposit received within 10 days from receipt of such refusal notice.

4. Payment Terms
4.1 Upon conclusion of the Agreement, the amount paid by the Customer as an advance payment shall constitute an earnest money deposit pursuant to Article 1385 of the Italian Civil Code and shall be retained by The Best Rent S.r.l. in the event of cancellation by the Customer.
4.2 The Customer shall pay the balance of the first rental instalment in advance upon signing the Agreement at check-in. Subsequent payments shall be due according to the terms specified in the lease agreement. Cash payments may only be made at the landlord’s offices by appointment and for amounts not exceeding €4,999.
4.3 A representative of The Best Rent S.r.l. shall record the gas and electricity meter readings at check-in and check-out.
4.4 If the Customer is required to pay the tourist tax to the Municipality of Milan, such payment shall be made through The Best Rent S.r.l., acting as tax collector in compliance with applicable regulations.

5. Security Deposit
5.1 Upon signing a temporary lease agreement (over 30 days), the Customer shall pay The Best Rent S.r.l. a non-interest-bearing security deposit. The security deposit shall guarantee compensation for any damage caused by the Customer to the Property and may also be applied by The Best Rent S.r.l. toward payment of any other outstanding sums owed by the Customer.
Within 72 working hours from check-out (or completion of inspection and verification procedures), The Best Rent S.r.l. shall refund the entire security deposit to the Customer. If damages or malfunctions caused by the Customer are found, The Best Rent S.r.l. shall refund the residual amount after deducting the amounts due.
5.2 For stays shorter than 30 days, The Best Rent S.r.l. shall make a pre-authorization on the Customer’s credit card for a specified amount as a security deposit. If no damages or malfunctions caused by the Customer are found, The Best Rent S.r.l. shall release the authorized amount within 10 working days.
5.3 Upon vacating the Property, and in any case within 15 days from receipt of a formal payment request from The Best Rent S.r.l., the Customer shall remain liable for payment of any additional damages caused to the Property by themselves or the other occupants that exceed the amounts covered under sections 5.1 and 5.2.

6. Cancellation Policy
6.1 The amount paid by the Customer as an advance payment shall become an earnest money deposit once the Agreement has been concluded pursuant to section 3. The amount of the advance payment, and therefore the earnest money deposit, shall vary according to the duration of the Customer’s stay at the Property.
6.2 If the Customer cancels the reservation at any time prior to arrival at the Property, or in the event of a no-show at check-in, The Best Rent S.r.l. shall be entitled to retain the entire amount paid as the earnest money deposit.
6.3 If the Guest decides to terminate the stay early for any reason and the Agreement duration is less than 30 days, the Guest shall not be entitled to any refund and The Best Rent S.r.l. shall retain the entire amount received.
If the Agreement duration exceeds 30 days, the Guest must provide at least 30 days’ notice; otherwise, the Guest shall be liable for a penalty equal to one month’s rent. In any event, the Guest shall remain liable for all accrued expenses pursuant to section 4 and for amounts due to restore any damages found by the Grantor.

7. Delivery of the Property
7.1 To complete the delivery and access procedure for the Property (check-in), the Customer must be present at the agreed date and time at the selected Property. At that time, the Customer shall sign the lease agreement and a handover report containing electricity and gas meter readings and any existing damage to the Property.
The handover report shall be signed by the Customer on behalf of themselves and all occupants of the Property, after which the representative of The Best Rent S.r.l. shall hand over the keys or access codes to the Property. From the moment the keys or access codes are delivered, the Customer shall become custodian of the Property and shall be liable to The Best Rent S.r.l. and the rightful owner for any damage, breakage, or malfunction.
7.2 At check-in, the Customer must show the representative of The Best Rent S.r.l. the identity documents of all persons who will occupy the Property.
7.3 The Customer must promptly notify The Best Rent S.r.l. of any delay with respect to the scheduled check-in time and hereby releases The Best Rent S.r.l. from any liability for disruptions caused by such delay.
The standard assisted check-in hours are from 3:00 PM to 9:00 PM; requests outside this time frame must be agreed in advance with The Best Rent S.r.l.
In case of delay in check-in procedures, if not communicated at least two hours before the scheduled check-in time indicated at the time of booking, check-in shall not be guaranteed.

8. Customer Obligations
Without prejudice to the obligations assumed under the lease agreement, the Customer hereby guarantees that every person occupying the Property is lawfully present in Italy and, if a foreign national, complies with any visa and residence permit requirements imposed by public security regulations, assuming direct responsibility for the truthfulness of such declaration.
The Best Rent S.r.l. shall communicate the identity details of the occupants of the Property to the Public Security Authority.

9. Privacy
9.1 The Customer expressly authorizes The Best Rent S.r.l. to process their personal data and to provide such data, pursuant to Legislative Decree No. 196/2003 and subsequent amendments, to parties delegated by The Best Rent S.r.l. for the purposes of carrying out the provisions of these general terms of service and the lease agreement.
9.2 The Customer acknowledges that the purpose of processing their personal data is limited solely to the execution of the agreement by The Best Rent S.r.l. and its appointed representatives.
These general terms of service shall be governed by Italian law and interpreted according to the Italian language.
In the event of discrepancies between any translated version and the Italian version, the interpretation based on the Italian version shall prevail.
For matters not expressly provided for in these general terms of service, reference shall be made to the laws in force from time to time.

Privacy Policy for the website visitors pursuant to Article 13 of the UE Regulation 679/2016

This Privacy Policy complies with Article 13 of the UE Regulation 2016/679 ("Regulation”) and explains our privacy policy and how your personal data are treated when you visit our website (www.thebestrent.it, “Website”), so that you can express your consent to the treatment of your personal data explicitly and consciously, when it is required. The information and data you provide us with, or that we collect in any other way when you visit our Website or enter its reserved area (“Services”) will be treated pursuant to the Regulation and the principles of data protection, which inspire the activities of The Best Rent.
Pursuant to the Regulation, The Best Rent is committed to process your personal data lawfully, fairly and in a transparent manner, restricting the purposes of processing and archiving, minimizing data collection and ensuring accuracy, integrity and confidentiality, in accordance with the responsibility principle of Article 5 of the Regulation.


1. DATA CONTROLLER
The Best Rent S.r.l., with headquarters in Viale Monte Nero 59, 20135 Milan (“The Best Rent” or “Data Controller” or “We”), is committed to protect the privacy of the visitors of its website. Before sharing any personal data of yours with the Data Controller, please read this Privacy Policy carefully, because it contains important information about how your personal data are protected.


2. PERSONAL DATA SUBJECT TO THE TREATMENT
Personal data subject to processing may include, depending from the services required: identification information (your name, identification number, localization data, online identification code), one or more features regarding your personal, physiological, psychical, economic, cultural or social identity, which may either identify or make you more easily identifiable.
Personal data collected by our Website are the following:


a) Navigation data
Information systems and software procedures allowing the Website to work properly, automatically collect web browsing information, required by Internet communication protocols. Although the purpose of colleting this information is not to identify visitors, this may happen by associating and elaborating it with data owned by third parties. This category comprises: IP address, domain names of the computers used by visitors of the Website, URIs (Uniform Resource Identifier), time of the request, method of submitting the request to the web server, size of the file sent to the system, numeric code indicating the status of the request given by the web server (successful, error, etc.), other indicators of the visitors’ operating system and web infrastructure. Collecting this information allows us only to get anonymous statistics, which show how the Website is used and if it works properly, i.e. we can detect problems/frauds. Data are immediately destroyed after being processed. Data may be processed in the event of internet crimes suffered by the website or by third parties.

b) Special categories of Personal Data
If you access the services offered by the Website page “Work with us” (www.thebestrent.it/lavora-con-noi), we may collect some of your personal data belonging to the special categories mentioned by the Article 9 of the Regulation: “[…] personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation”. Please do not disclose this information if not strictly necessary. If you disclose special categories of personal data without any explicit consent to the processing, which still allows you to send your curriculum vitae, The Best Rent will neither bear liability nor be subject to any reprimand, because you have authorized the data to be processed by publicly and personally disclosing them pursuant to Article 9.1.e) of the Regulation. Notwithstanding that, we recommend you explicitly give your consent to the processing of special categories of personal data, if you decide to share them.
During the CV screening process, The Best Rent may visit the profiles of the candidates freely available on professional social networks on the Internet (such as LinkedIn).


c) Data collected through Cookies
What are cookies?
When you browse our Website, you may detect cookies, i.e. short pieces of data sent by websites to the visitor’s browser (the program you use to surf the net, such as Chrome, Explorer, Mozilla, etc.), where they are stored and later sent back to the same websites upon the following visits. When you navigate a website, you may be tracked by cookies of websites and web servers of other providers (i.e. “third parties” cookies). You find detailed information in the sections of our website dedicated to special services. Some of them may be provided upon registration, so that your personal data are required. We can make a distinction between technical cookies, which allow the website to work properly and can be used freely, and profiling cookies, which display advertising based on the interests of visitors whilst browsing the website. Profiling cookies must be accepted by visitors.

f) Data collected for the purpose of the booking
The website www.thebestrent.it showcases the services and the activities of The Best Rent. According to your own preference, you can book accommodation in the apartments we manage directly or whose reservations we are responsible for.
After choosing the accommodation you prefer, you must provide The Best Rent with the following data, in order to complete the reservation: name, surname, date of birth, fiscal code and/or VAT number, address of residence, ID number, phone number, fax and email address.
We will use these data to complete the reservation and manage the deposit/down payment only. When the hospitality contract is signed, you will receive a new, detailed statement regarding this kind of data processing.


3. PURPOSE OF DATA PROCESSING
Your data will be processed in order to:
3.1 allow you to browse the Website and successfully provide our services, such as ensuring the Website security and managing the reservations;
3.2 fulfill the obligations enforced by applicable laws, regulations or the EU legislation, or comply with the instructions of the authorities;
3.3 carry out statistical analysis, without tracing the identity of the person;
3.4 screen CVs and give feedbacks to the candidates who sent their application through the website page “Work with us”;
3.5 send newsletters and communications for direct marketing via email, text message, mms, push notifications, fax, mail, telephone with operator assistance, either directly or indirectly through third parties providing marketing and communication services;
3.6 carry out profiling activities by collecting and analyzing the choices and preferences of the Website’s visitors, with the aim of sending personalized offers about products and/or services.
Security measures are applied to avoid data loss, illegal or wrong use, and non-authorized access.

4. LAWFULNESS OF PROCESSING, COMPULSORY OR OPTIONAL PROCESSING
Article 6.1.b) of the Regulation serves as legal basis for personal data processing for the purposes of Section 3.1: personal information processing is required to provide services or to satisfy your requests.
Article 6.1.c) of the Regulation serves as legal basis for personal data processing for the purposes of Section 3.2 (“processing is necessary for compliance with a legal obbligation to which the controller is subject”). Giving consent to personal data processing for these purposes is optional, but refusing to consent would prevent the required services from being provided.
Please note that the operation of data processing as provided for in Section 3.3 is not based on personal data, therefore no limitation is foreseen upon the Controller. With reference to point 3.4 and the analysis of the social profiles on professional platforms available on the Internet as mentioned in Section 2.b, the legal basis for personal data processing falls within the scope of Article 6.1.f) of the Regulation, i.e. the legitimate interest of The Best Rent to ensure the candidate is suitable for the vacant position.
The legal basis for personal data processing for the purposes of Sections 3.5, 3.6 and 3.7 falls within the scope of Article 6.1.a) of the Regulation, since consent is required to process personal data. Consent is optional and can be withdrawn anytime with no consequence, apart from the fact that you will stop receiving marketing communications, and/or no profiling activities will be carried out. Previous consent can be withdrawn following the instructions of Paragraph 8 of this Privacy Policy.
If data processing serves the purpose of sending advertisement, promoting direct selling, carrying out market researches or sending commercial communications for products or services offered by the Controller and similar to those currently purchased by the User, The Best Rent can use email addresses pursuant to and within the scope of the legislation in force (ex Article 130, Sub-article 4 of the Privacy Regulation) and as prescribed by the Data Protection Authority regulation of 19 June 2008, also when no explicit consent is given. Legal basis for this operation of data processing is Article 6, Sub-article 1, Letter f) of the Regulation. You have the right to refuse or withdraw consent for this operation of data processing any time, immediately or following later communications, easily and with no charge, by writing to the contacts listed in the “Contacts” section. Interruption of the data processing will be notified immediately (Article 15 of the Regulation).

5. BENEFICIARIES OF THE PERSONAL DATA
The personal data we collected may be shared for the purposes described in Section 3 of the Privacy Policy with the following:
5.1. people acting as Data Processor pursuant to Article 28 of the Regulation, i.e. people working with the Data Controller for the purposes described above, including those carrying out technical maintenance (jointly known as “Representatives”); the list of external Data Processors may be asked to the Data Controller in writing using the contacts listed in the "Contacts” section of this Privacy Policy;
5.2. people, bodies or authorities we are obliged to disclose your personal information to, as prescribed by the law or following the provisions of competent authorities;
5.3. people committed to maintain confidentiality or placed under a reasonable confidentiality obligation by law, who pursuant to Article 29 of the Regulation process personal data in order to perform activities strictly related to the provision of services, under the authority of the Data Controller.
The updated list of those who may process personal data as Data Processor will be provided by sending a written request to the Data Controller using the contacts listed in the “Contacts” section of the website.

6. TRANSFER OF PERSONAL DATA
Although transferring personal Data to Countries not belonging to the European Economic Area is not foreseen by our standard procedure, we inform you that data processing complies with one of the provisions of the regulations in force, including consent of the subject, application of Standard Clauses approved by the European Union, choice of entities belonging to International programs for the free movement of data (such as the EU-USA Privacy Shield) or operating in Countries considered safe by the European Commission. More information will be provided upon request by the Data Controller at the contacts listed above.

7. RETENTION OF DATA
Personal data processed for the purposes listed in Section 3.1 are retained for the time strictly necessary to satisfy these purposes. In any case, since processing aims at providing services, the Data Controller will keep personal data for the time prescribed and allowed by the Italian regulations protecting legitimate interests (Article 2946 of the Civil Code and later amendments).
Personal data processed for the purposes listed in Section 3.2 are retained for the time prescribed by the applicable legislation or pursuant to legal obligations.
More information about how long data will be kept and applicable laws can be requested in writing to the Data Controller at the contacts mentioned in this Privacy Policy. The Data Controller has the right to keep personal data for the time prescribed and allowed by the Italian regulations protecting legitimate interests (Article 2947 of the Civil Code).

8. DATA SUBJECT RIGHTS
Pursuant to Article 15 and later amendments of the Regulation, you have the right to ask The Best Rent to: access, rectify or delete your Personal Data; object to the processing or restrict its scope in the circumstances set out in Article of 18 of the Regulation; obtain your data in an structured, commonly used and machine readable format, in the circumstances set out in Article 20 of the Regulation.
Requests of this kind must be made in writing to the Data Controller using the contacts listed in this Privacy Policy. Pursuant to Article 77 of the Regulation, you always have the right to lodge a complaint with the Data Protection Authority, if you have concerns about your Personal Data not being handled in compliance with the law.

9. CHANGES
We may change or update the content of this Privacy Policy from time to time, entirely or in part, to comply with changes in the applicable law. We encourage you to visit this page regularly to be informed of the latest changes of the Privacy Policy and be updated about how The Best Rent uses your personal data.
